TERMS OF TRADE

Product Use - Our tools are recommended for use on all composite materials as recommended in our "Wide Range Of Uses" section. They are not recommended for use on steel and any such use is at the owners own risk.

Our Contract - We must receive payment in full for the goods before your order can be accepted and despatched. Payment made by cheque will be subject to a clearance period as set by our Bankers and goods will only be despatched thereafter.

Price - The prices quoted on this website are inclusive of GST. These prices are ex works our warehouse and postage rates as set out by Australian Post will apply. You will be informed of these postage rates on checkout.

Delivery - We will despatch the goods ordered by you as soon as reasonably practicable to the address you give us for delivery at the time you made your order. The standard delivery method will be by Australia Post and will be either 'Regular' or 'Express' as per your decision at the time of checkout. We will not be liable for any loss of goods that are being delivered by Australian Post and ownership for the goods will pass onto you upon despatch. It is possible to post parcels by Registered mail (insurance up to $100 included). Additional insurance can also be taken out at $1.10 per $100 or part thereof. To request this you must contact us for a quote.

We are also able to deliver goods up to 3Kg by overnight Courier if you so wish. The cost for this would be $9.50 and you must contact us should you wish your goods to be despatched by this method. We are unable to accept any responsibility for goods that are lost by this delivery method and ownership for the goods will pass onto you upon despatch.

If we are unable to despatch your order within 3 working days from payment having been cleared, we will advise you and arrange another delivery time. You will become the owner of the goods you have ordered on despatch of them to you. Once goods have been despatched to you they will be held at your own risk and we will not be liable for their loss or destruction

Returns - You may return any of the goods delivered to you within 7 days of the date of delivery to our contact address at your own cost and risk. Any sum debited to us from your credit card will be re-credited to your account as soon as possible for any such returned goods PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in, when delivered to you.

Availability -  We endeavor to hold sufficient stock to meet all orders. However, should we not have sufficient stock to fill your order, we will contact you as soon as possible with an expected delivery date. If this is not to your liking, any sum debited by us from your credit card will be re-credited to your account as soon as possible. We will not be obliged to offer any additional compensation for disappointment or inconvenience suffered.

Cancellation - You may exercise your right to cancel your order within 7 days of receiving said order. Goods are to be returned to our contact address at your own cost and risk. We shall refund you the price you paid for any goods returned, PROVIDED THAT such goods are returned by you and received by us in the condition they were in when despatched to you.

Liability - We will not be liable to replace any tools or for any consequential damage that may result from the use of our tools on materials or in applications that are not recommended by us. You may return any of the goods delivered to you (including those which are not what you ordered, are damaged or defective, or where the delivery is of an incorrect quantity) upon notifying us of your intention to return such goods and the problem with them. They must be returned to us within 30 days of the date of their delivery to you. Goods are to be returned to our contact address at your own cost and risk. We shall refund you the price you paid for any goods returned, PROVIDED THAT such goods are returned by you and received by us in the condition they were in when despatched to you.

If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be (at our option): to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective (this must be as a result of the manufacturing process and not we will not be liable for any transport or bad usage damage); or to refund to you the amount paid by you for the goods in question in whatever way we choose.

We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.

All terms, conditions, warranties and representations expressed or implied by statute, applicable local law or otherwise in relation to the goods you order are excluded. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Force Majeure - We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

Complaints Procedure - On contacting us regarding a complaint, please give your name, address, and telephone number or e-mail address. If having purchased goods from us also please provide us with the invoice number. Clearly state your complaint or problem and we will by return acknowledge your correspondence. We will try to resolve the problem within 3 days of receipt of your correspondence. We also welcome any comments or suggestions for improving our service to our customers.

Invalidity - If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected.

Governing Law - The contract between us shall be governed by and interpreted in accordance with English law, and the Australian courts shall have exclusive jurisdiction to resolve any disputes between us.

Entire Agreement - These terms and conditions, together with our current web site prices, delivery details and contact details, set out the whole of our agreement relating to the supply of the goods to you by us. These terms and conditions cannot be varied except in writing signed by one of our Partners. In particular nothing said by any of our staff should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. We shall have no liability for any such representation being untrue or misleading.

Use of Trademarks - The Perma-Grit® Tools trade mark is registered to Ian Richardson. No right or license must be intended by the buyer to be transferred by the Seller for the use of any of the trade names, trademarks, registered marks of, or used by, Perma-Grit® Tools
